Happy Thanksgiving!

Geoff Sharp (a mediator from New Zealand) recently launched the innovative mediationvblog where mediators the world over can post video blogs (video clips) on any topic related to mediation.

I recently submitted this clip here.  Now, I have to confess there isn’t any great mediation marketing “meat” here–it is just the introduction to a recent NJAPM ”Build The Dream Marketing Workshop.”  I promise to provide more substance in future clips.  I also had just lost my voice and we had no time to get set up in the room but sometimes something is better than nothing eh?

You also won’t want to miss Geoff’s interview series “What Trial Lawyers Want” where he interviews New Zealand trial attorneys about what they like and don’t like in mediators.  The most recent interview issues a warning for evaluative mediators.  There is a fine line between asserting some control over the process and entering the murky waters of providing judgments about likely outcomes.

I am sure it will come as no surprise to you that mediator flexibility is a key element — being able to move with the flow of the mediation process and what the parties and lawyers to the process desire you to contribute.  I have heard this complaint from lawyers I have interviewed– they are disturbed by the mediator’s mantra “I don’t do that” when they are asking for some help.  Remember, within ethical and practical boundaries your job is to serve in the best way you know how and to respond to the needs of your clients.
